This advice relates to England and Wales. Scotland and PSNI has its own legislation and processes. This advice has been produced in consultation with the Staff Officer to the NPCC Lead for Mental Health and Policing, and the Mental Health Casework Section (MHCS) at the Ministry of Justice who oversee the restricted patient system under Part III of the Mental Health Act 1983 on behalf of the Secretary of State for Justice.
